KANHA Treats Terms of Service

By accessing or using the KANHA Treats website (the “Site”) or any services offered through the Site, you (“User” or “you”) agree to be legally bound by these Terms of Service (“Terms”), our Privacy Policy, and all other policies referenced herein. These Terms form a binding legal agreement between you and Sunderstorm, Inc., a California corporation (“Company,” “we,” “our,” or “us”), operating the KANHA Treats brand.
If you do not agree to these Terms, you must immediately cease using the Site and all associated services. Your continued use of the Site following any modifications to these Terms constitutes your acceptance of those modifications.
These Terms should be read in conjunction with our Privacy Policy, Cookie Policy, and any additional terms applicable to specific features or promotions.
You must be at least 21 years of age to access, browse, or use this Site or to purchase any cannabis products. We reserve the right to cancel or modify your order prior to fulfillment if a product becomes unavailable, if a pricing error is identified, or for any other reason at our discretion. You will be notified promptly and any charges will be refunded.Returns and Refunds
Due to the nature of cannabis products and applicable state regulations, we do not accept returns of cannabis products. If you receive a product that is damaged, defective, or incorrectly fulfills your order, please contact us within 7 days of receipt at info@sunderstorm.com or (866) 988-7405. We will review your claim and, if warranted, arrange for a replacement or refund in accordance with applicable law and our internal policies.Delivery services, availability, and applicable fees are subject to state and local cannabis regulations in the jurisdiction where delivery is requested. Not all products or services are available for delivery in all areas.
You must be present to accept delivery and must present valid, government-issued photo identification confirming you are at least 21 years of age at the time of delivery or pickup. Orders may not be left unattended. If you are not present or cannot provide acceptable ID, your order will not be completed and a redelivery fee may apply.
We are not responsible for delays or non-delivery caused by circumstances beyond our reasonable control, including acts of government, road closures, natural disasters, or regulatory restrictions.
You may be required to create an account to access certain features or to make purchases. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activity that occurs under your account.
You agree to notify us immediately at info@sunderstorm.com if you suspect unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to terminate accounts, restrict access, or remove content at our discretion, with or without notice, for violations of these Terms or applicable law.

- Post or transmit any false, misleading, defamatory, or illegal content
- Harass, threaten, or abuse other users or our employees or agents
- Violate the rights of any third party, including intellectual property rights, privacy rights, or rights of publicity
We reserve the right to investigate suspected violations and to cooperate fully with law enforcement authorities in connection with any illegal activity conducted through or in connection with the Site.
All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, user interface elements, software, and compilations thereof (collectively, “Content”), is the property of Sunderstorm, Inc. or its licensors and is protected by U.S. and international copyright, trademark, trade dress, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Content solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, or sell any Content without our prior written permission.
The KANHA Treats name and logo, the KANHA brand name and logo, and all related marks are trademarks of Sunderstorm, Inc. or its affiliates. Use of these marks without our express written permission is strictly prohibited.
If you believe that any content on the Site infringes your copyright, please notify our designated DMCA agent at info@sunderstorm.com with the subject line “DMCA Takedown Request,” and include a description of the allegedly infringing material, its location on our Site, your contact information, and a statement of good faith belief and authority to act on behalf of the copyright owner.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUNDERSTORM, INC., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, PRODUCTS, OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCTS OR SERVICES, SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100), OR (B) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
Nothing in this section limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.
We are not liable for any failure or delay in performance resulting from a regulatory action, license suspension or revocation, government mandate, act of God, natural disaster, pandemic, or other event beyond our reasonable control (Force Majeure). In such events, we will provide prompt notice and will resume performance as soon as reasonably practicable.
You agree to defend, indemnify, and hold harmless Sunderstorm, Inc. and its affiliates, directors, officers, employees, agents, licensors, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
- Your use of or access to the Site
- Your violation of these Terms
- Your violation of any applicable law, including cannabis laws in your jurisdiction
- Your infringement of any third-party right, including intellectual property, privacy, or publicity rights
- Any false or misleading information you provide to us
We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with us in asserting available defenses.
Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact us at info@sunderstorm.com to describe your concern and allow us a reasonable opportunity to resolve it informally. We will attempt to resolve the matter within 30 days of receiving your notice.Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures, before a single arbitrator. The arbitration shall take place in Los Angeles County, California, unless you and we agree otherwise.Class Action Waiver
YOU AND SUNDERSTORM, INC. EACH AGREE THAT ANY PROCEEDING, WHETHER IN ARBITRATION OR COURT, SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.Small Claims Court
Notwithstanding the above, either party may bring an individual claim in small claims court if the claim qualifies.Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. For any dispute not subject to arbitration, you consent to exclusive personal jurisdiction in the state or federal courts located in Los Angeles County, California.FDA Disclaimer
